Terms & Conditions

These terms govern your use of this website and the gaming sessions you book through it. By booking a session or using our facilities at APEX GAMING ROOM, you agree to them. If you do not agree, please do not use the site.

In these terms, "we", "us" and "our" mean ALGOMETRIX PRIVATE LIMITED. "You" means the person booking or using a session.

2. What we sell

We sell time on gaming equipment at our premises — consoles, gaming PCs, VR headsets, racing rigs and similar — booked by the slot. This is a service delivered in person at our cafe. Nothing is shipped or dispatched to you.

Food, drinks and snacks are sold separately at the counter and are not part of an online booking unless bought as a named combo.

3. Online bookings

A booking is confirmed only after successful payment of the full session amount.
Each booked unit has its own duration and controller count, chosen by you at checkout. The minimum online booking is 30 minutes per unit.
Sessions may start between 9:00 AM and 10:00 PM. All sessions end by 11:00 PM.
An order confirmation is an acknowledgement of your booking, not an unconditional acceptance. We may cancel and refund in full if the equipment becomes unavailable, a pricing error is discovered, or the booking appears fraudulent.
Availability shown on the site is live but not reserved until payment completes. In the rare case two customers pay for the same slot within seconds, the later booking is refunded in full.

4. Session timing

Your session runs on the booked clock. It begins at the booked start time and ends at the booked end time, whether or not you arrive on time.
Arriving late does not extend the session. Unused time is not refunded and cannot be carried forward.
Extending your session on the day is subject to that unit being free, and is charged at the counter at our standard rates.

5. Pricing

All prices are in Indian Rupees (INR) and are displayed in full before you pay. There are no hidden charges added after checkout.
Prices are inclusive of applicable taxes unless stated otherwise at checkout.
We may change our rates, offers and combo prices at any time. The price shown at the moment you pay is the price that applies to that booking.

6. Payment modes

Online bookings are paid in advance through Paytm Payments Services Limited, using UPI · Credit & Debit Cards · Net Banking · Wallets.

At the cafe counter we also accept cash and UPI.

All online payments are processed on the payment partner's own secure, PCI-DSS compliant page. We never see or store your card number, CVV, UPI PIN or banking credentials. See our Privacy Policy.

If an amount is debited but your booking is not confirmed, the payment is reversed automatically. See Refunds & Cancellations.

7. Refunds and cancellations

Refunds are governed by our Refunds & Cancellations policy, which forms part of these terms. In short: we refund in full when we cannot provide your booked session, and we do not refund a session missed through late arrival or a no-show.

8. Conduct and equipment

Handle consoles, controllers, headsets and other equipment with care. Damage caused by misuse may be charged at replacement cost.
We may refuse or end a session without refund in cases of abusive behaviour, intoxication, damage to property, or breach of house rules.
Please supervise children in your party. Customers under 18 are welcome with a parent or guardian.

9. Acceptable use of this website

You agree not to attempt to gain unauthorised access to this site or its database, upload malicious code, scrape or overload the booking system, or place bookings fraudulently. Breach may result in cancellation of your bookings, a block on further access, and legal action.

10. Intellectual property

All content on this website — the APEX GAMING ROOM name and logo, page text, layout, graphics, photographs of our premises and equipment, and the booking software itself — is our property or is used with permission, and is protected by copyright and trade mark law.

You may not copy, reproduce, republish, distribute or use any of it commercially without our prior written permission. Console, game and hardware names and logos shown on this site are the trade marks of their respective owners and are used only to describe the equipment available at our cafe.

11. Limitation of liability

Our total liability for any booking is limited to the amount you paid for that booking.

To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of data, loss of game progress or saved files, loss of opportunity, or any inconvenience arising from a session being unavailable, interrupted or ended.

We are not liable for interruptions caused by circumstances outside our reasonable control, including power failures, internet outages, hardware faults, publisher or platform outages, government restrictions, or natural events.

Personal belongings brought to the cafe remain your responsibility. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence.

12. Indemnity

You agree to indemnify us against any claim, loss or cost arising from your breach of these terms, your misuse of our equipment, or damage you cause to our property or to another customer.

13. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these terms, this website, or a booking made through it is subject to the exclusive jurisdiction of the courts at Haldwani, Nainital, India.

14. Severability

If any part of these terms is found unenforceable, the remainder continues to apply in full.

15. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you book is the version that applies to that booking. The date below shows when it last changed.

16. Grievances and contact
